Well, at least UDM suspended and then fired Bacari. Yes, the prompt suspension of BA for seven games would seem to counter the claim that “the university didn't handle Jones' complaint seriously.”

Seems to me that Jones (and his attorney) is fishing for a settlement. I only got a C- in my Torts class, but I don’t really see a good case for damages here. Coach used some vulgar language at a basketball practice. Being a D1 athlete is challenging and I’d guess most guys who sign up for it know that their coaches might blow up from time to time. Jones ended up having academic problems and basically got dismissed from the university the next semester. I suppose his attorney will say he suffered emotion distress and couldn’t function as a student because of the verbal abuse.
Seems like total BS to me. I hope Detroit Mercy fights it and doesn’t settle.

I know of a grocer that would give "nuisance settlements" of $2k if someone claimed that they had a slip and fall in the store. This was in the early 90's before high definition CCTV's were in every grocery store.

In his 3 years after high school, the young man went to 2 different JUCOs; signed with Louisiana-Monroe; withdrew from his NLI with that school; and, ended up here where he created a mountain out of a molehill over BA's comment; and, then can't maintain grades at a 1.9 GPA. He had a lawyer speaking for him from the outset. And the essence of his lawsuit is that he should have been treated like a girl under Title IX. No wonder some of his teammates ridiculed him.
Most telling about the newspaper article is the omission of what he said in the huddle that prompted BA's response.
BA was put on leave (or call it a suspension) shortly after he made his first complaint. One or both of his parents stated publicly that they wanted BA fired. Then, BA was fired six weeks before end of the second semester in 2018. So, he was gone from campus and Jones still couldn't get a 1.9 GPA in his classes.
The thing is that by filing the lawsuit, Jones will lose his privacy rights about his entire academic history at every school he has attended. By claiming emotional damages, he will lose his doctor/therapist- patient privilege. And BA's version of the events as well as the testimony of other teammates and coaches will now become public.
IMO, he has received consistently poor advice here. Whatever chances he had to gain a pro contract somewhere in the world will likely evaporate when these things become public knowledge. He is not so talented that a GM would want to overlook how he responded to this incident. I wouldn't want him on my team if I were the GM or coach. So, what talents off the court does he possess? Would you want this kind of emotional person coaching your boy or girl? In the end, this is a sad situation; and, I worry about the future for Tariiq Jones.

Not my area of law, but aren’t the odds pretty good that a judge looks at this and gives summary judgment? I just don’t see a case here at all. I don’t think this meets the Michigan threshold for intentional infliction of emotional distress. Unless there’s some case law about people in authority positions verbally abusing students?
Maybe if there is no summary judgment the school offers Jones something like $50,000 which would in theory be enough to enroll at a new school, earn a degree, and make him whole? I suppose that wouldn’t make good if Jones says he had a plan to become a professional athlete and that BA’s actions have derailed that. But, that’s just laughable to me.
Interestingly enough, if this goes to trial, the case might ask if BA was fired for his verbal abuse of Jones or just because BA is a bad basketball coach. Just my opinion, but I think the online message boards would be good evidence for UDM to submit to show that BA was just a really bad basketball coach. Gentlemen ... prepare to be famous.

The claim seems absurd - that a coach's vulgar comment could make a player so afraid that he failed to remain academically eligible. Especially when the university permitted the public to believe that the head coach had been suspended. Seems like an excuse rather than the truth.

Detroit Lion Darius Slay (traded today) accuses team head coach Matt Patricia of going “Bacari Alexander” on him:
“He told me in front of the whole team, in the team meeting room, showed clips of me in practice getting a ball caught on me or so in practice," Slay said. "I posted a picture (of a wide receiver on Instagram), and he told me, stop sucking this man’s private. So I’m like, 'Whoa.' I’m like, 'Hold up.' Where I’m from, that don’t fly. Cause I wouldn’t say that to him. I wouldn’t say to him to stop you know what to Bill Belichick. I wouldn’t do that. That’s just not me as a man. That’s disrespectful to me and so from there on it was done with."

In an updated version of the Detroit News story, there is a statement from attorney Andrew J. Laurila that he is considering appealing the decision. The guy is a UDM Law grad, wonder if he ever comes to Calihan to watch the Titans. Maybe when the University gets around to finally building a natatorium, Andy will help bankroll a water polo team (his sport in undergrad at U-M). Here’s his bio from the firm’s website:
Andrew is the team leader for the employment discrimination and civil rights section at Rasor Law. His team focuses on aggressive and relentless representation of victims of severe employment discrimination and wrongful governmental conduct. These cases involve robust and determined advocacy against employers and governmental personnel who harm their workers, employees and the public by failing to comply with the law and cause serious harm to their workers, including wrongful termination, discrimination and hostile work environment based upon race, gender, sexual orientation, religion, national origin, pregnancy and handicap.
Prior to joining Rasor Law, Andrew worked for the dark sith lord representing insurance companies. There, he gained a healthy disgust for how the defense side demeans injured people and attempts to cheat them out of justice.
EDUCATION
A graduate of University of Detroit Mercy School of Law and University of Michigan, where he was a member of the water polo team, Andrew is enthusiastic and dedicated to using his legal education, skill training and experience to help victims of serious employment discrimination and wrongful governmental conduct obtain justice against wrongdoers.

The court got it right. Glad this situation is now behind the program. I actually feel bad for Jones. I think he got some bad advice probably from his parents and this attorney.
I went to UDM law. It’s mostly producing good people but there are always a few douchebags like this Laurila guy in every class.
